We aim to become the platform that enables achievers to reach a much greater level of success and to utilize their success to benefit society and the economy.

The following terms and conditions ("Terms") govern your use of the Site and Services (as defined below) and you should read them carefully. By using the Site, you indicate that you accept and agree to these Terms. If you do not agree to these Terms, do not submit an application, do not register and do not access or otherwise use our Site.   We recommend that you print a copy of these Terms for future reference.

These Terms include:

  •   Terms of Use – our Terms of Use are set out in Part 1 of these Terms and govern the use of our Site by Visitors (as defined below) and by Members (as defined below);


  •   Membership Terms – our Membership Terms are set out in Part 2 of these Terms and govern our provision and your use of our paid services. These paid services (collectively called the "Services") include access to the membership area of the website which provides access to and use of a variety of resources including download areas, communication forums and notification of upcoming events such as member's dinner and other products and services offered by Tomouh to Members (attendance at such events is subject to separate terms and conditions);


  •   Privacy Policy – our Privacy Policy is set out in Part 3 of these Terms and sets out terms on which we process any personal data we collect from you or that you provide to us. By using our Site and/or our Services, you consent to such processing and you warrant that all data provided by you is accurate;


  •   Cookie Policy – our Cookie Policy is set out in Part 4 of these Terms which sets out information about the cookies on our Site; and


  •   Acceptable Use Policy - our Acceptable Use Policy is set out in Part 5 and sets out the permitted uses and prohibited uses of our Site.

Registered users of our Site are "Members" and unregistered users are "Visitors".

To use this Site, either as a Visitor or as a Member, or any of the Services, you may need to download software and/or content and/or agree to additional terms. You are responsible, at your own cost, for making all arrangements necessary for you to access the Site and use of the Services.

You may access some areas of the Site without being a Member. However, certain areas of the Site are only accessible to you if you are a Member.


We may amend these Terms from time to time. Every time you wish to use our Site and/or the Services, please check these Terms to ensure you understand the Terms that apply at that time. In such circumstances if you are a Member, you may be entitled to cancel the Contract and receive a refund under the CANCELLATION AND REFUND section of the Membership Terms. This will be the limit to the extent of our liability to you in such circumstances.


We may update and change our Site from time to time to reflect changes to, for example, our users' needs or technical, operational or other business priorities   . We will try to give you reasonable notice of any major changes.


Our Site is made available free of charge (although certain areas of the Site are only accessible to you if you are a Member and have paid your membership fee).

We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Site for business, technical and/or operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

If you are a Visitor, we will not be liable to you if, for any reason, the Site is unavailable at any time. If you are a Member, our liability is limited to any refund that you may be entitled to under the provisions of the Cancellation and Refunds section of the Membership Terms.


We are the owner or the licensee of all and any intellectual property rights in our Site and our Services, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You must not use any part of the materials on the Site for commercial purposes without obtaining a licence to do so from us or our licensors.

You may print off one copy, and may download extracts, of any page(s) from our Site for your personal use.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our Site must always be acknowledged.

This information and these materials have not been verified or approved by us. The views expressed by other Members (or Visitors) on our Site do not represent our views or values.

Access to the Site is provided "as-is" and your use of the Site is at your own risk. To the fullest extent permitted by law we expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, under common law or otherwise.

We exclude any liability for unforeseen loss or damage incurred by you in connection with the Site or in connection with the use, inability to use or results of the use of the Site or the Services, howsoever caused.

Unless you have entered into any Contract with us for the supply of Services, we exclude any liability for foreseeable loss or damage incurred by you in connection with the Site or in connection with the use, inability to use, or results of the use of the Site, howsoever caused.

If you have entered into a Contract with us for the supply of Services in accordance with the membership Terms below, our liability to you in relation to those Services shall in no circumstances exceed a sum equal to the sums paid by you to us for the provision of those Services during the twelve months preceding the date on which the event giving rise to our liability occurred.

Loss or damage is foreseeable if either, it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the application process.

For the avoidance of doubt, we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

Please note that we only provide our Site for domestic and private use. You agree not to use our Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.


Whenever you make use of a feature that allows you to upload content to our Site, or to otherwise make content available to other Members, you must comply with the content standards our Acceptable Use Policy.

You warrant that any such contribution complies with those standards, and you will be liable to us and indemnify us for any breach of this warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you upload to our Site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us a limited licence to use, store, copy and publish that content and to distribute it to other Members. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our Site constitutes a violation of their intellectual property rights, or of their right to privacy.

We have the right to remove any posting you make on our Site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.

You are solely responsible for securing and backing up your content.


When you upload or post content to our Site, you grant to us a worldwide, non-exclusive, fully paid up, royalty-free, perpetual, irrevocable licence to use, copy, modify, distribute, publish, and process information and content that your provide through our Services, or otherwise, without further consent, notice and/or compensation to you or others.

You agree that we may access, store and use any information that you provide in accordance with the terms of our Privacy Policy.

By submitting suggestions or other feedback regarding our Services to us, you agree that we can use and share (but do not have to) such feedback for any purpose without compensation to you.


We do not guarantee that our Site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our Site. You should use your own virus protection software.

You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site and our Services will cease immediately.

To the fullest extent permissible by law, we will not be liable to you for any loss or damage caused by a distributed denial-of-services attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or Services or to your downloading of any material posted on it, or any website linked to it.


You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our Site in any website that is not owned by you.

Our Site must not be framed on any other site, nor may you create a link to any part of our site other than the home page .

We reserve the right to withdraw linking permission without notice.

These Terms, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident in another jurisdiction, in which case you may also bring proceedings in your home jurisdiction.

"TOMOUH", “TOMOUH COMMUNITY” and "TOMOUH NETWORK" are trade marks of Tomouh Limited. You are not permitted to use them, or any confusingly similar mark, without our approval, unless they are part of material you are using as permitted under the HOW YOU MAY USE OUR MATERIAL section above.


If any court or competent authority decides that any of the provisions of these Terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.


Any words following the terms including, include, in particularfor example or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.


These Membership Terms, together with our Terms of Use, Privacy Policy, Cookie Policy and Acceptable Use Policy, set out the entire agreement between you and us relating to the provision by us to you of the Services made available through the Site.

If you wish to receive the full range of Services provided by us, you must be a Member.

The Services provided by us include the provision of a membership account to you and enabling you to access a range of paid member-only content hosted on the Members area of the Site. This allows you: (i) to communicate with other Members either via the Site or via email; (ii)   access to and use of a variety of resources including download areas, communication forums; and (iii) access to other products and services, including information on upcoming events. Please note that attendance at such events will be subject to separate terms and conditions. More details on the Services can be found at the emails or linked you receive relating to the events.


To apply to become a Member of Tomouh, you must submit your C.V. or biography (your "Application") by email to info@tomouh.net (or by any other method to which we agree). Following our receipt of your Application, we will review your Application. If we, in our absolute discretion, decide that the information you have provided in your Application satisfies our membership criteria, we will consider approving your Application for membership, but w   e do not guarantee you membership.

We reserve the right to approve or refuse any Application for membership for any reason (provided the reason is permitted by law). By submitting an Application, you consent to us verifying any information that you provide in that Application with relevant third parties or by any other means, to help us decide whether to approve your Application.

If we approve your Application, we will send you a welcome email. The welcome email will request that you (i) complete the registration form located at http://www.tomouh.com/registration.html; and (ii) pay the membership fee, either through our Paypal account by clicking on the link provided in the welcome email and following the instructions provided or by bank transfer to our nominated bank account (see welcome email for details of the nominated bank account).

Please note that you must complete the registration form and pay the membership within 5 (five) months from the date that we send you the welcome email, failing which we will deem your Application for membership as abandoned. Please do not make any payment after this period of time. We will not be responsible for any loss suffered by you as a result of making payment after this five month period. In these circumstances, if you still wish to be a Member, you will need to submit your Application again, in accordance with the application procedure set out above in this section. You acknowledge that we do not guarantee that we will approve your re-submitted Application.

We will use reasonable endeavours to activate your membership account within the five week period immediately following, the later of, (i) completion of your online registration; or (ii) receipt (in cleared funds) of your membership fee in our nominated account. We will notify you that your membership account has been activated by sending you an email, at which point a contract for the provision of our Services will come into existence between you and us ("Contract") and you will be bound by these Membership Terms (as well as our Terms of Use, Privacy Policy, Cookie Policy and Acceptable Use Policy).

You will be entitled to access our Services, using the login details we send to you in the activation email, meaning your membership with us will commence on the day that we send you an email notifying you that your membership account has been activated (the " Effective Date ").

Please note we reserve the right to change or adjust our membership criteria at any time.


Our membership fees are set out in the welcome email and, unless agreed otherwise, are payable in US dollars. We reserve the right to change the membership fee at any time and for existing Members we will notify you of this by email. However, for existing members such changes will only come into effect on the next annual payment due date. If the membership fee has increased and you do not want to pay it then you must promptly notify us of this at info@tomouh.net. In such circumstances, your membership will automatically terminate on the next payment due date and, on that date, we will disable your login details and if payment has been processed we will refund this to you.

To continue to receive the Services, you must pay the applicable annual membership fee to us on each anniversary of the Effective Date. Payment must be made in accordance with the instructions set out in the welcome email. Payment for the Services must be made in advance in cleared funds.

In addition to payment of the applicable membership fee, you will be liable to pay any and all foreign exchange fees or differences in prices based on location (e.g. exchange rates) that may be applied by your bank or any other financial institution.

We accept payment through our payment processing service providers, Paypal, Inc. The collection and processing by Paypal, Inc of your credit and debit card details and other personal data are governed by its terms and conditions.


If you opted for an automatic recurring payment method, you are deemed to authorise our designated payment processor to store your payment details and automatically charge your payment method (e.g. debit or credit card) the membership fee as and when payable, even after it has expired.

In the event that we (or our payment processor) are unable to process your membership fee for any reason whatsoever, your membership will be suspended for a period of thirty (30) days from the date that payment was due. If, after that 30 day suspension period, we still have not received or been able to process your membership fee, your Tomouh membership shall automatically terminate and your login details will be disabled, and we will not incur any liability for such action.


You must treat your login details ( user name and password) as confidential. You must not disclose it to any third party, including any other Members or do anything that is likely to jeopardise the security of your account. We have the right, at any time, to disable any user login details, whether chosen by you or allocated by us, and/or suspend and/or terminate your membership, if in our reasonable opinion (i) you have failed to comply with any of the provisions of these Terms; (ii) we need to safeguard your account; or (iii) we need to protect our Site from security threats.


If you knowingly provide your login details to another person your membership may be suspended or terminated.

If you know or suspect that anyone other than you knows your user name and/or password (or you have any other reason to believe that your account is no longer secure), you must promptly notify us at team@tomouh.net .

If you fail to notify us promptly, you will be liable for any losses incurred by Tomouh or any other Member due to any unauthorised use of your account.


To use our Services, you warrant and agree that:

  1. you are the "Minimum Age" (defined below) or older;
  2. at all times, you will have a maximum of one Tomouh membership account, which must be in your real name;
  3. you are not and have never been prohibited or otherwise restricted by Tomouh from using the Services;
  4. you are a consumer and will use the Services for domestic and private use and not for any commercial or business purposes;
  5. you are not a registered sex offender or terrorist and you do not have any unspent criminal convictions;
  6. you are not a competitor of Tomouh and you are not acting directly or indirectly in competition with us;
  7. you are acting on your own behalf and not on behalf of any other person;
  8. all information provided to us on your Application, on the registration form located at http://www.tomouh.com/registration.html, and at any other time, is true, accurate and complete;
  9. at all times, if any information that you provided on your Application and/or on the registration form located at http://www.tomouh.com/registration.html, or at any other time changes, you must promptly notify us of this by email and provide us with your up to date information;
  10. you have full authority and capacity to enter into the Contract; and
  11. you are not party to any agreement, arrangement or understanding with any third party that would prevent or hinder you from complying with these Terms.

"Minimum Age" means 18 years old for the United Kingdom. However if the law requires that you must be older for Tomouh to lawfully provide the Services to you (including the collection, storage and use of your information, in accordance with our privacy policy set out at Part 3 then the Minimum Age is such older age.

By submitting any information to us at any time, you authorise us to verify that information at any time, if required, to ensure such information is true, accurate and complete.


We provide a platform and environment for connecting Members with other Members and for sharing information with Members. You acknowledge that if you enter into any agreement, arrangement or understanding with any other Member or Members, we have no liability or responsibility in relation to such agreement(s), arrangement(s) or understanding(s). You are responsible for any interaction you have with another Member, whether through the Site or otherwise.


We reserve the right, at any time, to amend, change, add to, remove or cancel all or any part of the Services. In such circumstances, you may be entitled to cancel the Contract and receive a refund, see the "Cancellation and Refund" section of these terms below. This will be the limit to the extent of our liability to you in such circumstances.


We have no liability for any actions or omissions of any Member, unless such actions or omissions are directly attributable to us or our employees, our subcontractors or agents.

You agree to indemnify us against all liabilities, costs, expenses, claims, damages and losses and all other reasonable professional costs and expenses suffered or incurred by us arising directly out of or in connection with:

  1. any claim made against us by a third party, or another Member, arising out of or in connection with any materials or information that you post on our Site or any use or misuse of our Services by you, including any claim made against us for infringement of a third party's intellectual property rights; or
  2. your breach of any of the provisions in these Terms.



As a Member, you shall, at all times (including while using the Site, when sending direct messages or emails to other Members and when attending any events, meetings or other gatherings organised or facilitated by us), conduct yourself with integrity and in a professional manner and comply with certain rules, in particular you shall:

  1. use reasonable endeavours to reply, in timely manner , to any and all direct messages and direct emails sent to you from other Members. If you are busy, unable to help or otherwise unavailable, please let that other Member know;
  2. not make any statements or post any material that we consider to be hate speech, threatening, pornographic, defamatory, scandalous, abusive, obscene, discriminatory, unlawful, inciting violence, containing nudity or graphic or gratuitous violence;
  3. not post content or initiate any communications that we consider to contain any of the types of statements described in (ii) above though any account or group hosted by a third party website, such as Facebook, Twitter or Linkedin;
  4. not, without prior written consent from a Member, disclose that Member’s personal or professional data to any other person;
  5. respect all other Members and not interact with Members in a manner that we deem to be inappropriate or annoying;
  6. not, without our written permission, make requests for jobs or recruit or market for other organisations , events or groups;
  7. not make requests for capital investment, funding, financial support or references, or to initiate introductions to non -Tomouh contacts without appropriate prior networking or establishing a relationship with them;
  8. (viii) not post offers to Members on behalf of someone else; and
  9. (ix) comply with all applicable laws including privacy laws and intellectual property laws.

From time to time we may notify you of upcoming events, including (without limitation) Members' dinners and other services or offers specifically targeted at Members, on our Site or via email notification. If you purchase such services or offers, separate terms and conditions will apply and we will notify you of these prior to your purchase either via the relevant webpage or by email communication.


Although we try to ensure that the Tomouh network is a safe and professional environment in which to interact with other Members, you do so at your own risk.


If you decide to meet another Member, or any individual introduced to you by another Member or encountered at a Tomouh event, please take all necessary precautions.




A.   Your right to cancel the Contract under the Consumer Contracts Regulations 2013 (the "Regulations"):


Under the Regulations, consumers have certain rights to cancel contracts concluded at a distance. The Contract between you and us is such a contract and you have the right to cancel it within 14 days after the date the Contract is entered into (i.e.14 days after the date we send you the email notifying you that your membership has been activated, so if you enter into the Contract on 1 October, you may cancel at any time before the end of 15 October) (the “Cancellation Period”). Because our Services are subscription-based, you acknowledge and accept that they will be made available to you immediately on formation of the Contract and during the Cancellation Period.   If you (i) change your mind after making payment but before you have entered into a Contract with us; or (ii) cancel the Contract during the Cancellation Period, we will provide you with a refund. We may deduct from that refund an amount for the supply of the Service for the period for which it was supplied to you, ending with the time when you told us you wanted to cancel the Contract. The amount of any deduction will be in proportion to what has been supplied, in comparison with the full annual membership fee.


You may cancel the Contract by notifying us at info@tomouh.net before the end of the Cancellation Period. You do not have to give us any reason for your cancellation, but should inform us that you are exercising your right to cancel by a clear statement. The Regulations require us to provide the model cancellation form to you, which you may print or copy and complete, but you do not have to use the model form. The model cancellation form can be found at the bottom of this page. We will make the reimbursement without undue delay, and not later than 14 days after the date on which you inform us of your cancellation of the Contract. We will make the reimbursement using the same means of payment as you used for the initial transaction and will not charge you any additional fees for making the reimbursement.


If you change your mind about becoming a Member after making payment but before you have entered into a Contract with us, let us know by notifying us at info@tomouh.net and we will provide you with a full refund.


B. Your right to cancel the Contract in other circumstances:

You may cancel the Contract:


  • (a)  immediately, by written notice if: (i) we commit a material breach of any of the terms in these Terms, which breach is irremediable, or (if such breach is remediable) we fail to remedy that breach within a period of 30 days after being notified in writing to do so; (ii) we have suspended, withdrawn or substantially restricted availability of, or to, our Site or our Services for technical, business or operational reasons (please note that this does not include suspension of your account for reasons of non-payment), or notified you that we are going to do that, each for a period of 30 days or more; or (i) we make a change to these Terms and such change is to your detriment; or
  • (b)  on 30 days prior written notice for any other reason, where the Cancellation Period has ended.


If you cancel the Contract for the reasons set out in section (a) (i), (ii) or (iii) of this paragraph B, we will provide you with a refund of any membership fees paid to us for that membership year but we will make a deduction, such deduction will be in proportion to what has been supplied, in comparison with the full annual membership fee.


If you cancel the Contract the reason set out in (b) of this paragraph B, and the Cancellation Period has ended, you will not receive a refund of the membership fee for the membership year in which you cancel.


If you wish to cancel for any reason set out in this paragraph B, please notify us of this by emailing us at info@tomouh.net.


C. Our Right to Cancel the Contract:

We may cancel the Contract immediately, by written notice: (i) if you commit a material breach of any of the terms in these Terms, which breach is irremediable, or (if such breach is remediable) you fail to remedy that breach within a period of 14 days after being notified in writing to do so; or (ii) for any other reason.


If we cancel the Contract for the reason set out in (i) paragraph C, we will not refund you any of your membership fee for that membership year. If we cancel the Contract for reasons set out in (ii) paragraph C, we will provide you with a refund of the membership fee for that membership year but we will make a deduction, such deduction will be in proportion to what has been supplied, in comparison with the full annual membership fee.


Any refunds to be made under paragraph B or C will be made as soon as practicable and using the same means of payment that you used for the initial transaction. Please be advised that processing a request for cancellation and refunding you any amount due under these Terms may take up to 30 days (unless you are cancelling under paragraph A, in which case you will receive any refund from us not later than 14 days after the date on which you inform us of your cancellation of the Contract)


D. Reapplying for Membership

Should you wish to receive our Services again after cancelling your membership, you must submit a fresh application according to the application procedure set out in these Membership Terms.


We do not guarantee that your re-application will be successful. Returning as a Member to Tomouh after having your membership cancelled or terminated (for any reason) is subject to our absolute discretion.


You acknowledge that if your Contract is terminated or cancelled (for any reason) or expires, your membership automatically terminates. In addition, if your membership is terminated under these Terms, the Contract will automatically terminate. In each of these circumstances we will disable your login details.


The Contract shall commence on the Effective Date and shall continue, unless terminated earlier in accordance with this Contract, for 12 months ( Initial Term ), when it shall terminate automatically without notice unless, no later than 30 days prior to the end of the Initial Term (or any Extended Term agreed under this paragraph), we receive payment from you of the annual membership fee, in which case the term shall be extended for a further 12 months ( Extended Term ). Unless it is further extended under this paragraph or terminated earlier in accordance with this Contract, the Contract shall terminate automatically without notice at the end of an Extended Term.


If you wish to cancel the Contract or do not wish to extend the term of the Contract, you are responsible for deactivating your paypal account, or otherwise cancelling any automatic recurring payment for the annual renewal of your membership. If, following cancellation of the Contract or expiry of the Contract, payment for the next membership year is processed, we will refund this amount to you:


(i)      in full if you are cancelling for reasons set out in (a) (i), (ii) or (iii) of paragraph B above; or

         (ii)     if you are cancelling for reasons set out in (b) of paragraph B above or you do not want to renew    the term of the Contract, we will refund the amount paid less any amount reasonably incurred by us as a result of returning the payment.


We will not be liable for any failure to perform, or delay performance of, any of our obligations under a Contract that is caused by events outside our reasonable control including natural disasters, failures of telecommunications networks, power failure, failure of our suppliers, failure by any third party hosts or third party equipment that you use to access the Site and the Services, data loss and the acts of any government.


You may not transfer, assign or otherwise dispose of any Contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time.


Your privacy is very important to us. This Privacy Policy (together with our Terms of Use and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.   Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. This policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage. This is information about you that you give us by filling in forms on our Site or by corresponding with us by phone, e-mail or otherwise. It includes information you provide when you register to become a Member, subscribe to our Services, complete a profile, participate in discussion boards or engage in other functions on our Site and if you report a problem with our Site. The information you give us may include your name, email address, mobile number, nationality, location, occupation, schools/universities attended, employment history, certifications earned, bank account/payment details, password(s) and other data you upload or enter into your profile.

Each time you visit our Site we will automatically collect the following information:


  • technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your Internet Service Provider (ISP), your login information and frequency, browser or device type and version, operating system and platform;
  • information about your visit, collected using google analytics tools which may include any or all of the following: the full Uniform Resource Locators (URL), clickstream to, through and from our Site (including date and time), page response times, download errors, pages visited, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page.

  • to carry out our obligations arising from any Contract and to provide you with the information, products and services that you request from us;

  • to ensure that content from our Site is presented in the most effective manner for you and for your device.

  • to administer our Site and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

  • service providers (including payment service providers and providers of IT services), business partners, suppliers, contractors, sub-contractors, volunteers, or any other related parties for the performance of any contract we enter into with them or you;
  • advertisers and advertising networks that require the data to select and serve relevant adverts to you and others;
  • analytics and search engine providers that assist us in the improvement and optimisation of our Site;


We will disclose your personal information to third parties:


  • In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets.
  • If Tomouh or substantially all of its assets are acquired by a third party, in which case personal data held by it about its Members and Visitors will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Terms of Use or Membership Terms and other agreements; or to protect the rights, property, or safety of Tomouh, our Members and Visitors, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.


We shall not be in any way responsible for unauthorised use or disclosure of your personal data by any Member or third party which is due to your breach of our Terms of Use or this Privacy Policy.




The information that we collect from you may be transferred to, processed and stored at a destination outside the European Economic Area (" EEA "). It will also be processed by staff operating outside the EEA who work for us or for one of our service providers. This includes staff engaged in, among other things, the fulfilment of your Contract with us, the processing of your payment details and the provision of support services. By submitting your information to us, you agree to this transfer, processing and/or storing. We will take all steps reasonably necessary to ensure that your personal data is treated securely and in accordance with this Privacy Policy.


All information you provide to us (save for any financial or payment information) is stored on our secure servers.




Where you use a password which enables you to access certain parts of our Site, you are responsible for keeping that password and any other login details confidential. You must not share these details with anyone, or store them in a way that may allow a third party to access them. You must not allow anyone else to access or operate your account.


In addition, in order to protect your personal data, you should:

(iv)    to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards;

(v)    to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);

(vi)    to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;

(vii)   to advertise or recruit for other networks or entities directly or in-directly conflicting or in competition with Tomouh; or

(viii)   in any way other than as authorised under these Terms

 You also agree not to:

(i)     reproduce, duplicate, copy or re-sell any part of our Site in contravention of the provisions of our Terms of Use;

(ii)     access without authority, interfere with, damage or disrupt:

    • any part of our Site;
    • any equipment or network on which our Site is stored;
    • any software used in the provision of our Site; or
    • any equipment or network or software owned or used by any third party,

including removing, circumventing, disabling, damaging or otherwise interfering with security related features of our Site or reverse engineering, decompiling, disassembling or otherwise attempting to discover the source code of our Site or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law;

(iii)    access our Site through accounts of other Members' without permission, or forge another person’s digital signature, or misrepresent the source, identity, or content of information transmitted via our Site or perform any other similar fraudulent activity;

(iv)    impersonate any person or entity including impersonating any Tomouh spokesperson, employee or affiliate, speak on behalf of Tomouh, or falsely claim affiliation with any person, Member or entity;

(v)    communicate any unauthorized commercial communications (such as spam) using our Site or upload files to our Site that contain software or content protected by intellectual property laws (patents, trademarks, trade secrets, copyrights or other proprietary rights) or confidentiality, unless you own or control such rights or have received all necessary consents;

(vi)    directly or indirectly transfer any data you receive from us to (or use such data in connection with) any other social network, data broker, or other information reseller , even if a Member consents to such transfer or use;

(vii)   rent, lease, sell, resell, distribute any information or content provided by or related to us or modify, adapt, translate or create derivative works based on statements or material on our Site;

(viii)   except with our prior written consent, use our name (including "Tomouh", "Tomouh network" and any Tomouh logos) in connection with any events or publications, whether such event or publication is held offline or online; or

(ix)   misrepresent your relationship with us to others.




These content standards apply to any and all material which you contribute to our Site (contributions), including in relation to any interactive services associated with it, such as chat rooms, bulletins boards and messaging services etc.

You must comply with the spirit and the letter of the following standards. The standards apply to each part of any contribution as well as to its whole.


Contributions must:

(i)     be accurate (where they state facts);

(ii)     be genuinely held (where they state opinions); and

(iii)    comply with applicable law in the UK and in any country from which they are posted.

Contributions must not:

(i)     contain any material which is defamatory of any person;

(ii)     contain any material which is obscene, offensive, hateful or inflammatory;

(iii)    promote sexually explicit material;

(iv)    promote violence;

(v)    promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

(vi)    infringe any copyright, database right or trade mark of any other person;

(vii)   be likely to deceive any person;

(viii)   be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

(ix)    promote any illegal activity;

(x)    be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety or be otherwise objectionable;

(xi)    be likely to harass, upset, embarrass, alarm or annoy any other person;

(xii)   be used to impersonate any person, or to misrepresent your identity or affiliation with any person;

(xiii)   give the impression that they emanate from us, if this is not the case; or

(xiv)   advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse

While we use our reasonable endeavours to monitor the content on our Site, you may still encounter content that you find objectionable.

Help us maintain Tomouh as a safe, professional and trusted community by reporting any abusive behaviour that you encounter on our Site. If you see something on our Site that you find objectionable or you believe breaches this Acceptable Use Policy, please promptly report it to us at info@tomouh.net.

All Members are entitled to have differences of opinion, and it is inevitable. Members are expected to be prudent and disagree without offending others. Please remember that “to disagree” does not necessarily constitute “abuse.” “Abuse reports” on a Member who is unpopular is neither fair nor welcomed.


Please keep in mind that reporting against a message or a Member does not guarantee that the message will be removed from the Site or action taken against the Member, as, because of the diversity of the Tomouh community, it's possible that something could be objectionable to you without meeting our discretionary criteria for being removed or blocked.

We expressly exclude our liability for any loss or damage arising from the use of the Services by a Member or Visitor in contravention of our content standards, whether the service is moderated or not


We will determine, in our discretion, whether there has been a breach of the provisions of this Acceptable Use Policy, through your use of our Site and/or Services. When a breach has occurred, we may take such action as we deem appropriate.

Failure to comply with the provisions Acceptable Use Policy, constitutes a material breach of the Terms upon which you are permitted to use our Site, and may result in our taking all or any of the following actions:

(i)     Immediate, temporary or permanent withdrawal of your right to use our Site and/or Services.

(ii)     Immediate, temporary or permanent removal of any posting or material uploaded by you to our Site.

(iii)    Issue of a warning to you.

(iv)    Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

(v)    Further legal action against you.

(vi)    Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of the terms of this Acceptable Use Policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.


We may revise this Part 5, acceptable use policy, at any time. You are expected to check this webpage from time to time to take notice of any changes we make, as they are legally binding on you. Some of the terms contained in this acceptable use policy may also be superseded by provisions or notices published elsewhere on our Site.
